For the purposes of this Legal Notice, the term “User” shall refer to any individual or legal entity accessing the website to find information and make use of the services offered via the portal.

PURPOSE AND SCOPE OF APPLICATION

These general terms and conditions (hereinafter, “General Terms and Conditions” govern the access, browsing and use of the website at www.enar.es (hereinafter, the “Website”) and www.enargroup.com, as well as the responsibilities stemming from the use of their content (the term “Content” shall hereinafter be understood to mean the text, graphics, drawings, designs, codes, software, photographs, videos, audio, databases, images, expressions and information, as well as any other creation protected by Spanish law and international treaties on intellectual and industrial property). Nonetheless, Enarco may establish specific terms and conditions to govern the use and/or contracting of specific goods and services offered to the Users via the Website.

Before using the Website, the User must carefully read the corresponding specific terms and conditions established to said end by Enarco.

By using this portal, the User expressly accepts all of these General Terms and Conditions, as well as all those specific terms and conditions established for the use of certain services. If these General Terms and Conditions of Use are not accepted, the User must refrain from accessing and/or using the content offered. These General Terms and Conditions of Use govern the generic use of the portal by the User. The User may view and print said terms and conditions. The User must carefully read these General Terms and Conditions of Use each time they intend to use the Website given that they may be subject to change.

It shall be understood that access to or mere use of the Website by the User implies acceptance thereby of the General Terms and Conditions that Enarco has published at any given time on the Website and that shall be available to Users at all times.

USE OF THE WEBSITE AND LIMITATIONS ON USE

The content included on the Website are solely provided to consumers or end users. Any unauthorised commercial use or resale thereof is strictly prohibited unless prior written authorisation has been obtained from Enarco.

If the User is required to register for the use and/or contracting of a service on the Website, the User shall be responsible for providing accurate and lawful information.

The User is responsible for access, browsing and use of the Website, and therefore undertakes to diligently and faithfully follow any additional instructions given by Enarco or personnel authorised by Enarco regarding use of the Website and its content. Enarco does not necessarily share the opinions of Users and shall not accept liability for said opinions under any circumstances.

Therefore, the User undertakes to use the content diligently, correctly and lawfully, and specifically undertakes to refrain from the following:

Enarco complies with the provisions of (EU) Regulation 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of individuals regarding the processing of personal data and the free circulation of said data, under which Directive 95/46/EC is repealed, and seeks to guarantee the correct use and processing of the personal data of the User.

To that end, each personal data collection form in the services that the User may request from Enarco shall be accompanied by information for the User on the existence and acceptance of the specific terms and conditions on the processing of their data in each case, informing the User about the controller of the file created, the address of the data controller, their entitlement to exercise their rights of access, rectification, elimination, limitation on processing, portability or opposition, the purpose for processing and the sharing of data with third parties when applicable. Furthermore, Enarco informs the User that it complies with Spanish Law 34/2002 of 11 July on Services of the Information Society and e-Commerce and the provisions of the General Data Protection Regulation. User consent shall be requested for processing their email address for commercial purposes at all times.

Pursuant to Articles 8 and 32.1, Section Two, of the Spanish Intellectual Property Act, the reproduction, distribution and public communication of all or part of the content of this website for commercial purposes on any medium and by any technical means without prior authorisation from Enarco is strictly prohibited, including by way of merely making the same available. The USER undertakes to respect the Intellectual and Industrial Property rights held by Enarco. The User may view the elements comprising the website and even print, copy and store the same on the hard drive of their computer or on any other physical medium provided that such action is solely and exclusively for their own personal and private use. EXCLUSION FROM GUARANTEES AND LIABILITY

Enarco shall not accept, under any circumstances, any liability for damages of any nature that may be caused by, including but not limited to: errors or omissions in the content, lack of availability of the portal or the transmission of viruses or malware in the content, despite having adopted all the technical measures necessary to avoid the same.

AMENDMENTS

APPLICABLE LEGISLATION AND JURISDICTION

These Terms and Conditions are written in the Spanish language and subject to current Spanish legislation. For any dispute stemming from the use of the services offered or the content of the Website, the parties accept the jurisdiction of those Courts assigned competency under current legislation.

Enarco S.A. informs you that the personal data you provide in the emails you send us will be processed by Enarco S.A. as the owner of this website. The purpose for collecting and processing your personal data is to manage recruitment process(es) and the data shall be stored for as long as the recruitment process is open or for one (1) year from receipt of your email.

You may exercise your rights of access, rectification, opposition, limitation, data elimination, portability and not to be subject to a decision based solely on automated processing by writing to gdpr@enar.es at any time.

The legal grounds lie in the consent provided by the interested party.

Not entering the personal data indicated as required in the form may mean it will be impossible to respond to your request. You are also entitled to lodge a complaint with the watchdog.

Legal grounds for processing the data

The legal basis for processing of your data is as follows, also separated by the processing activities shown in the foregoing section:

  • The legal basis of data processed to attend to complaints that data subjects may made is the legitimate interest of the data subject.
  • The data processed to manage the candidates for jobs in the organization are based on the consent of the data subject.
  • The legal basis of data processed with the purpose of sending commercial communications about products, activities and services of ENARCO is the consent of the data subject.
  • The legal basis for data processed for video surveillance is public interest, to ensure the safety of persons, property and installations, as well as instruction 1/2006 on personal data processing for purposes of surveillance with cameras.

Temporary limitation on the processing of your data

Your personal data will be stored for the shortest time possible to comply with the purpose of the processing, in accordance with the data retention policy of the General Personal Data Protection Regulation 2016/679.

If you wish to limit the time period in which your personal data are processed, you must exercise your rights as indicated later.

Newly grouped by processing activity, the data storage period is as follows:

  • Information processed with the aim of managing queries received and answering them will be stored for the period necessary for management, resolution and subsequent follow-up of said complaint.
  • Information processed for the management of candidates for jobs in the organization will be stored for a maximum period of one year from its receipt.
  • Data processed with the purpose of sending of commercial communications will be stored as long as the data subject does not withdraw his/her consent or exercise his/her rights mentioned below.
  • Data processed in video surveillance will be stored for a maximum of 30 days.

Parties with which your data are shared

Unless legally required to do so, we will not share your data for any purpose other than that of which you have been informed. Your data will not be shared internationally. However, you will be informed of such action should it take place in the future.

Your data may be shared with the Group of Partner Companies* for the above purpose.

Confidentiality and security of the data

Enarco S.A. undertakes to use and process the personal data of users while maintaining the confidentiality thereof and to use the same in accordance with the purpose thereof, as well as to comply with its obligation to keep them and adapt all measures necessary to avoid the alteration, loss, processing or unauthorised access in accordance with the provisions of current data protection regulations.

www.enar.es cannot guarantee absolute security against the violation of data by fraudulent access thereto by third parties.

Rights in the processing of your data

You are entitled to obtain confirmation regarding whether Enarco S.A. is processing personal data that concern you or not.

As an interested party, you are entitled to access your personal data and request the rectification of inaccurate data or, as appropriate, request the elimination thereof when, among other reasons, the data are no longer necessary for the purposes for which they were collected.

Under certain circumstances, you may request that limitations be imposed on the processing of your data, in which case we will only keep them for the exercise of defence against complaints.

Under certain circumstances and for reasons related to your particular situation, you may oppose the processing of your personal data. In such cases, we will cease to process your data, except for overriding legitimate reasons or the exercise/defence of possible complaints.

If you still believe that your personal data have not been processed appropriately in accordance with the law, you may contact the Spanish Data Protection Agency and lodge a complaint with them.

Acceptance and consent
